Do You Know What To Do If You Are Arrested?

Do You Know What To Do If You Are Arrested?

Are you a fan of police dramas? If you are, you’ve probably seen hundreds of arrests dramatized for television. Real life arrests, however, are nothing like the dramas you see on your favorite programs. It is important to learn how to protect your rights if you are ever arrested. There are some things you should not do if you want to protect yourself.

Remain calm and do not resist arrest. Controlling your emotions is vitally important if you are facing arrest. Go along calmly with the police during an arrest, even if you believe the police are mistaken. In most circumstances, however, make sure that you do not invite the police into your home or give them permission to search your residence. The law protects you from an illegal search, as long as you don’t give permission. The police must have a warrant or probable cause to search your property.

If the police ask you questions about their investigation, before talking to them, ask them to call your attorney. Just as your rights indicate, any statement you make to the police can be used against you in court. If you are questioned, simply say “I would like to speak with my attorney.” It is your legal right to have an attorney present when you speak to police, and it is in your best interests.
