    Penalties for a DUI/DWI

    The penalties for driving under the influence vary, and are decided during a sentencing hearing at the end of the court process. Penalties can include temporary license suspension, extensive fines, community service or even jail time.

    DUI School and Alcohol or Drug Treatment

    DUI School is almost always a part of a DUI/DWI sentence. This is a short educational program for people convicted of driving under the influence and focuses on safe driving habits. The court may also mandate alcohol or drug treatment, especially for repeat offenders.

    License Suspension

    After a DUI/DWI arrest your license is suspended until court proceedings are completed. At sentencing the court can chose to continue a temporary suspension for a time. Even If your license and driving privileges are returned to you points will be added to your licensealong with restrictions. Common restrictions include the time of day when you may drive, areas you may drive in and possible limits allowing driving for activities such as work and religious services. If you are convicted of repeated offenses your license may be revoked all together.

    Jail Time or Community Service

    Often a DUI/DWI conviction requires community service and probation. During your probation you are usually not allowed to drink at all. If you violate your probation terms, or do not complete your community service hours you may be sent to jail for a time.

    The court may sentence jail time of various lengths based on the severity of the offense. The court considers factors such as your blood alcohol content at the time of the offense, compliance with breathalyzer testing, reckless driving and the presence of children in your car in setting jail time.
