    Should I Take a Breathalyzer Test?

    Field sobriety tests, including a breathalyzer, are not required. You are also not required to answer questions that might incriminate you. If you are stopped on a suspected DUI/DWI, then it’s important to understand the situation and know your rights.

    Most of the time the officer who pulled you over has already decided to arrest you. The field sobriety tests and questions are designed to provide additional evidence to justify their decision. While it is important to remain polite, you do not need to participate. Simply ask toconsult with an attorney before taking any tests or answering questions.

    Understand that under Connecticut law, if you refuse the breathalyzer, your driver’s license will be automatically suspended for 6 months. Accordingly, this is an important decision.
