Wondering what you should expect after a DUI/DWI arrest? Prior to an arrest, a police officer must establish probable cause. Once this is established, the driver must be read their Miranda rights before being taken into custody and driven to the police station for booking.
If you are arrested, the police officer will begin by recording your personal information. This includes your name, date of birth, license number and physical characteristics such as height and eye color. This information is used during a record search for any previouscriminal activity.
When you are arrested, expect to be fingerprinted and have your picture taken. An officer will then search you and confiscate any personal belongings. These items are returned to you when you are released. Lastly, anyone arrested for a DUI/DWI is placed in a holding cell until they can post bail.
During arraignment the judge reads the charges. Make sure you have an attorney with you to protect your rights during the process. You will enter a plea of guilty, not guilty or no contest at this time. The judge then sets a bail amount or releases you on your own recognizance. Your next court appearance date is set at this time.
Bail may be posted by your family or friends after your arrest. Prior to your release you must agree to attend all court proceedings related to your DUI/DWI charge.
