How Does a Title IX Sexual Misconduct Proceeding Start at Yale?

At Yale, a Title IX sexual misconduct investigation begins after a formal complaint is filed with the University-Wide Committee on Sexual Misconduct (UWC). That complaint is received by the UWC Chairperson who consults with UWC members to decide whether the complaint actually violates Yale’s policies. If those conditions are met, the UWC Secretary will inform you that a complaint has been filed and provide materials about the allegations against you.

Who is Involved in a Title IX Sexual Misconduct Investigation at Yale?

The Yale Deputy Provost for Health Affairs and Academic Integrity is the school’s coordinator for Title IX compliance and tasked with making sure the UWC’s processes meet the legal requirements of Title IX laws. However, an individual proceeding itself is largely handled by the UWC.

What Happens During a Yale Title IX Investigation?

After a formal complaint is filed, the UWC will appoint 5 individuals to a hearing panel. As the best Yale school discipline lawyers know, the UWC will then appoint a “fact-finder” (investigator) to look into the allegation(s) and do what their title says, gather facts. This can include gathering documents and interviewing witnesses from the incident in question. This factfinder then writes a final report for the UWC Secretary. This report serves as the basis for the UWC to conduct a formal hearing on the allegations against you.

What Are My Rights If I Have Been Accused of Sexual Misconduct at Yale?

These proceedings typically last 60-90 days from filing of a formal complaint through a final decision. It’s a fast-paced process that can be hard to handle on your own.

Fortunately, you are guaranteed the right to an advisor throughout a Title IX proceeding. The advisor can be there to aid students during meetings with factfinders and at any formal hearing. Having an experienced attorney as an advisor can help you navigate the unknown terrain by explaining what to expect during the investigative process and preparing you for your hearing.

    What is Title IX?

While Yale has not adopted any official changes to their policies in light of these new rules, they are likely coming down the pike soon.
